The Washington County Board of Supervisors of Washington County, Nebraska, met in regular session at 9:30 a.m. on Tuesday, January 26, 2010 in the Supervisor’s Meeting Room at the Courthouse in Blair, Nebraska.

Notice of the meeting was given in advance thereof by publication in the Pilot-Tribune. A copy of the proof of publication is on file in the Office of the County Clerk. Notice of the meeting was given to the members and a copy of their acknowledgment of the receipt of notice and the agenda are on record at the office of the County Clerk. Availability of the agenda was communicated in the advance notice and in the notice to the members. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Chairman, Duane Wilcox declared the meeting was in session and that the meeting was being recorded.  Chairman made note that the Open Meetings Law was posted on the door and the north wall. Present: Chairman, Duane Wilcox, County Board Members, Linda Thomsen, Kent Clausen, Jeff Quist, Mary Alice Johnson and Ernest Abariotes.  Ron Hineline was absent all day.  Also present, County Clerk Merry Truhlsen.

 

It was moved by Abariotes and seconded by Quist that the rules be suspended and that the minutes of the January 12, 2010 meeting be approved but not read at this meeting for the reason that all Board Members were furnished a copy of said minutes prior to the meeting. Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes.  Nay: None. Motion carried.

 

The following correspondence had been received: Dept of Rev November lodging tax is $1,229.14, NIRMA quarterly loss report and agenda for County Board’s workshop and NIRMA’s workshop.  Motion Quist and second by Clausen to receive correspondence and place on file. Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

Chairman asked to have an emergency item placed on the agenda.  Chairman stated he and Deputy County Attorney Talbot had discussed sending a letter to the NRD and as the next NRD meeting is Feb 9, the same day as the next County Board meeting, he would like Washington County’s letter presented to them before that date.

Motion Clausen second Thomsen to add:  “Chairman Wilcox RE:  Deputy County Attorney Talbot drafting a letter to the NRD” to the agenda as an emergency item.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

Cheryl Parsons, Road Supt. and Julie Ogden, JEO, spoke about the December 15th meeting on improvements to County Road P39 and County Road 39.  Ogden handed out a letter that included a summary of the comments received and preliminary costs for each road as it was presented.  Ogden discussed the traffic counts, accidents and the intersection of CR39 and CR P32 that most people agreed needed to be improved.  Quist gave Ogden another comment he had received.  Clausen stated he didn’t feel the County could commit to anything right now, due to the high costs incurred with the winter storms, but maintenance and safety issues for the roads would be dealt with.  Public comment was heard by Bill Burdess, Wes Stamp and Robbin Jeffrey.  Motion Quist second Clausen to receive the information regarding improvements to CR P39 and CR39 compiled by Ogden and place on file.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

Julie Ogden also informed the Board she had the plans and specifications complete for the box culvert replacement on CR 31.  This was scheduled to be done in this year’s budget but Parsons had informed Ogden there may not be money available to complete this project.  Ogden stated the cost estimate was between $60,000 and $65,000 and had added an alternate bid item of a rock stilling basin for $15,000.  Motion Thomsen second Clausen to table the bid letting on CR31 box culvert.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

Deputy County Atty Ed Talbot had a juvenile grant fund application for the Chairman to sign.  Talbot discussed the juvenile county aid grant project that was set up three years ago.  Funding had been received one year; didn’t apply for the grant last year.  Funds from this point forward will be used for a part-time coordinator and if grant funds are not available, the part-time position is gone.  The grant money is made available from the Crime Commission.  Next year, application will be made for another three year grant.  Every first offender juvenile will have the opportunity for diversion, unless it’s some serious crime.  The other thing the Co Atty’s Office would like to do is to add a pre-trial diversion program, which the Board has already approved.  Motion by Thomsen second Clausen to authorize the Chairman to sign the juvenile grant application.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

Talbot had drawn up a Road Deviations Notice to be filed in Register of Deeds Office as per the November 10th Board meeting on Glen Oaks Subdivision.  Clerk read the Notice.  Board discussed the Notice.  Motion Clausen second Thomsen to authorize Chairman to sign Notice and file with Register of Deeds Office.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

Parsons handed out changes made at the Road Committee meeting to the One & Six Year Plan and asked when the public hearing should be.  Board discussed dates in February and determined the One & Six Year Plan public hearing will be Thursday, February 18th, at 7:00 P.M. in the multi-purpose room at the Courthouse.      

 

Kathy Rhea, Loess Hills Resource Conservation & Development Council, gave a brief summary of services provided by the council.  Motion Thomsen second Clausen to approve payment to Loess Hills RC&D in the amount of $1,200.00.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

Doug Wolfe, with OPPD, said around Christmas there were crews called out to restore power that got stuck on the impassable roads.  Wolfe talked to Parsons and she had contractors open the roads and get the crews going.   Wolfe wanted to say thank you and let Parsons, the Road Dept employees and the Board know how much he appreciated their assistance in getting power restored.

 

At 10:45 Board discussed the emergency item that was added to the agenda.  Chairman said he would like  Talbot to prepare a letter to the NRD Finance and Legal Committee, which meets Feb 9.  This letter would be in regard to LB160, passed last year in the legislature.  LB160 gives the NRD bonding authority and also states, in certain instances, that this is subject to the County Board’s approval.  Wilcox stated at their last meeting, the NRD was requesting $13.3 million, but didn’t specify what projects the money would be used for.  Motion by Clausen second Thomsen to authorize Talbot to prepare a letter to NRD expressing the Board’s concern with their using bonding authority without specifying what projects the money is to be used for.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

In accordance with Statute 23-1608, the County Board hired the CPA firm of Goracke, Ritterbush & Piotrowski to perform a complete and comprehensive annual audit of the books, accounts and records of all County Officers.  An original copy of the audit report through June 30, 2009 is on file with the Washington County Clerk.  Motion by Thomsen second by Quist to receive and place on file the Washington County audit from Goracke, Ritterbusch & Piotrowski through June 30, 2009.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

At 11:05 the Board entered into a closed session regarding collective bargaining issues with the Sheriff’s Union.

Sheriff Mike Robinson was in attendance.  Motion Clausen second Thomsen to go into closed session at 11:05 A.M.  The reason for the closed session was to discuss collective bargaining issues.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.  Motion Abariotes second Quist to end closed session at 11:15 A.M.  The reason for the closed session was to discuss collective bargaining issues.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.  No action was taken.

 

Don Dittman, Control Services Inc had been asked to evaluate some problems the Law Enforcement Building had been experiencing with the heating and cooling system.  Dittman initially was asked to do a proposal for the main office area and handed that out, but the Board requested he address the whole building.  Board discussed some recent problems and Dittman cited changes to be made, making it compatible to the system in the rest of the Courthouse.  Motion Clausen second Quist to table upgrading the HVAC system in Law Enforcement Building.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

 

At 11:43 A.M. the Board convened as Board of Equalization, see separate minutes.  Board adjourned from BOE at 12:03 A.M. and reconvened in regular session.

 

Motion by Clausen second by Thomsen to table the agenda items Ron Hineline had requested discussion on as Hineline was absent due to a family emergency.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

                                   

Comments from Public:  Dennis McCormick had a hand out on funeral expenses.  Chairman asked Johnson to look into County burial expenses.  William Burdess spoke of the cost of law enforcement.

 

Claims were received and reviewed, after which it was moved by Quist and seconded by Clausen that the following claims be allowed and Clerk ordered to issue warrants on the various funds for the same.  Vote- Aye: Thomsen, Clausen, Quist, Wilcox, Johnson and Abariotes. Nay: None. Motion carried.

There being no further business to come before the Board at this time, it was moved by Quist and seconded by Clausen that the meeting be adjourned until the next regular Board meeting date, Tuesday, February 9, 2010. All members present voted aye, Chairman declared meeting adjourned.
